DMCA Notice and Takedown Policy

Introduction

Featurefold (“Site”) respects the intellectual property rights of others and expects its users to do the same. As a service provider under 17 U.S.C. § 512(k)(1) of the Digital Millennium Copyright Act (“DMCA”), we are committed to complying with the DMCA’s notice and takedown procedures. This policy outlines how claims of copyright infringement will be handled.

Submitting a DMCA Notice of Claimed Infringement

If you believe that material available on the Site infringes your copyright, please send a written notification to our designated copyright agent with the following information:

  1. Your Contact Information: Full name, mailing address, telephone number, and email address.

  2. Description of the Infringed Work: A description of the copyrighted work you claim has been infringed. For multiple works, you may submit a representative list.

  3. Identification of the Infringing Material: Provide the URL or specific location of the material on our Site.

  4. Good Faith Statement: A statement that you have a good faith belief that the use of the copyrighted material is unauthorized.

  5. Accuracy and Authorization Statement: A statement, under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.

  6. Signature: Your physical or electronic signature.

Failure to provide all the required information may render your notice ineffective.

Takedown Procedure

Upon receiving a valid DMCA notice, the Site will:

  1. Remove or disable access to the alleged infringing material.

  2. Notify the user responsible for the material.

  3. Inform the user about their right to submit a counter-notification.

Submitting a Counter-Notification

If you believe the removal of your material was due to an error or misidentification, you may submit a counter-notification containing:

  1. Identification of Removed Material: The specific material removed and its prior location on the Site.

  2. Good Faith Statement: A statement under penalty of perjury that you believe the material was removed in error.

  3. Consent to Jurisdiction: A statement consenting to the jurisdiction of the Federal District Court in your judicial district or any district in which the Site operates.

  4. Contact Information: Full name, address, telephone number, and email.

  5. Signature: Your physical or electronic signature.

Send the counter-notification to the designated copyright agent at the address above.

Repeat Infringer Policy

The Site enforces a strict policy against repeat infringers and reserves the right to terminate accounts that repeatedly violate copyright laws.

Abuse Notification

Misuse of the DMCA notice or counter-notification procedures may result in legal action, including liability for damages, court costs, and attorney’s fees, under 17 U.S.C. § 512(f).
